OFFICIAL RULES
NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.
THIS GIVEAWAY IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH INSTAGRAM, TIKTOK, OR LIONSGATE.
This Giveaway is sponsored by Stila Cosmetics, 420 Lexington Avenue, Suite 1603, New York, NY 10170 (“Sponsor” or “Stila”).
This Giveaway is a separate and independent promotion and is not associated with, and entries will not count toward, any other contest, sweepstakes, or promotion currently being offered by Stila Cosmetics.
1. ELIGIBILITY
The Stila Cosmetics x THE HUNGER GAMES: SUNRISE ON THE REAPING Mailer Giveaway (“Giveaway”) is open only to citizens or legal residents of the 50 United States and the District of Columbia, excluding Puerto Rico and all United States territories and possessions, who are eighteen (18) years of age or older at the time of entry.
Employees, officers, directors, representatives, and agents of Stila Cosmetics (“Sponsor”), the participating creator associated with this Giveaway, Lionsgate, and each of their respective parents, affiliates, subsidiaries, advertising and promotional agencies, and members of their immediate families or households are not eligible to enter or win.
Void where prohibited or restricted by law.
2. GIVEAWAY PERIOD
The Giveaway begins at [START TIME] Eastern Time (“ET”) on [START DATE] and ends at [END TIME] ET on [END DATE] (“Giveaway Period”).
The Sponsor’s designated systems will be the official timekeeping device for the Giveaway.
3. AGREEMENT TO OFFICIAL RULES
Entrant’s participation in the Giveaway constitutes Entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding. By participating in the Giveaway and submitting an Entry, Entrant expressly agrees to participate in supporting marketing and other promotions and endorsements for Sponsor and its partners.
4. HOW TO ENTER
During the Giveaway Period, eligible entrants may enter through the Giveaway posts. The Giveaway will be conducted through separate Giveaway Posts published by the following participating creators (each, a “Participating Creator”):

Each Participating Creator’s Giveaway constitutes a separate promotion with a separate winner and prize. An entry submitted through one Participating Creator’s Giveaway Post will not constitute an entry into another Participating Creator’s Giveaway.
To receive an eligible entry, entrants must:

Follow @StilaCosmetics on [Instagram/TikTok];

Like the Giveaway Post; and
-
Comment “I LOVE YOU LIKE ALL FIRE 🔥” on the Giveaway Post and tag at least one friend.
Each eligible comment submitted in accordance with the requirements above will count as one (1) entry.
Entrants may submit a maximum of ten (10) eligible comment entries per person during the Giveaway Period.
Entrants must continue to follow @StilaCosmetics and maintain an account that allows the Sponsor to contact them by direct message through the time a winner is confirmed.
No purchase is required to complete any method of entry.
Use of multiple or fraudulent accounts, identities, registrations, automated entry methods, bots, scripts, macros or other automated means to exceed the permitted number of entries is prohibited and may result in disqualification.
Entries that are late, incomplete, illegible, fraudulent, generated by automated means, or otherwise fail to comply with these Official Rules may be disqualified in Sponsor’s sole discretion.
5. SEPARATE CREATOR GIVEAWAYS
Stila Cosmetics may conduct similar giveaways through other participating creators. Each creator’s giveaway constitutes a separate promotion with a separate winner and prize.
An entry submitted on one participating creator’s Giveaway Post does not constitute an entry into another participating creator’s giveaway. Subject to the applicable Official Rules for each promotion, eligible individuals may enter more than one creator giveaway.
6. PRIZE
One (1) winner will receive:
One (1) Stila Cosmetics x THE HUNGER GAMES: SUNRISE ON THE REAPING influencer mailer.
Approximate Retail Value (“ARV”): $384 USD. The ARV of the prize represents Sponsor’s good faith determination.
The prize consists only of the items included in the designated mailer.
Prize is non-transferable and may not be redeemed for cash. No prize substitution will be permitted except at Sponsor’s discretion if an advertised prize or component becomes unavailable, in which case Sponsor may substitute an item of equal or greater value. You agree that Sponsor shall not be liable for any damages or losses you incur using or related to the Prize.
All applicable federal, state, and local taxes and any expenses not expressly included in the prize description are the sole responsibility of the winner.
7. WINNER SELECTION AND ODDS
One (1) potential winner will be selected at random from all eligible entries received during the Giveaway Period.
The random drawing will take place on or around [DRAWING DATE].
Odds of winning depend on the total number of eligible entries received. All entries are subject to verification of eligibility by the Sponsor. All decisions regarding prize awards will be made by Sponsor and are final and binding. In the event of noncompliance with these Official Rules, or if the prize is unclaimed or returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner drawn from remaining eligible entries.
Sponsor shall not be responsible for late, misdirected, illegible, incomplete, garbled, or incorrect entries. Participation constitutes acceptance of these Official Rules in their entirety. Entrant warrants that he/she is eligible to participate in the Giveaway and agrees to indemnify and hold harmless Sponsor from any loss, damage, or expense, including, but not limited to, personal
injury, death, or damage to or loss of property, arising out of or in connection with participation in this Giveaway or the acceptance, use, or misuse of any prize.
8. WINNER NOTIFICATION AND VERIFICATION
The potential winner will be contacted by direct message from the official @StilaCosmetics account on or around [WINNER NOTIFICATION DATE].
The potential winner must respond within seventy-two (72) hours of the initial notification and provide any information reasonably requested by Sponsor to verify eligibility and arrange prize delivery.
Sponsor will never require payment or credit card information from a potential winner in order to claim the prize.
The potential winner may be required to provide proof of identity, age, residency and/or other information necessary to confirm eligibility.
If a potential winner:

cannot be contacted;
-
fails to respond within seventy-two (72) hours;
-
is found to be ineligible;
-
fails to comply with these Official Rules; or
-
declines or is unable to accept the prize,
the potential winner may be disqualified and Sponsor may select an alternate potential winner at random from the remaining eligible entries.
A potential winner is not an official winner until eligibility has been verified by Sponsor.
An Entrant may decline to be a Winner by notifying Sponsor within one (1) business day following notification, in which case the declining Entrant forgoes any prize or other features associated with winning the Giveaway. Sponsor reserves the right to disqualify an Entrant if Sponsor deems disqualification appropriate.
A list of Giveaway Winners will be available upon request. By accepting your prize, you agree to have your name provided as a Giveaway Winner upon request by any Giveaway Entrant or other third party.
9. PRIZE DELIVERY
The confirmed winner must provide Sponsor with a valid U.S. shipping address.
Sponsor will arrange for shipment of the prize following winner verification. Sponsor is not responsible for any prize that is lost, stolen, damaged or misdirected after shipment due to circumstances outside Sponsor’s reasonable control.
If a prize is returned as undeliverable, Sponsor may consider the prize forfeited and may select an alternate winner.
10. GENERAL CONDITIONS AND PARTICIPANT WARRANTIES
By participating, entrants agree to be bound by these Official Rules and by the decisions of Sponsor regarding the administration and interpretation of the Giveaway, which shall be final and binding to the extent permitted by law.
By submitting an entry to the Giveaway, you agree that you have full right and authority to enter and participate in the Giveaway on your own behalf and that your entry: (i) does not contain confidential information; (ii) does not violate the rights of privacy of any person or entity; and (iii) does not and will not violate any applicable law, statute, ordinance, rule, or regulation. You are solely responsible for your entry. All entry information is deemed collected in the United States.
Participation is subject to all federal, state, and local laws and regulations. Void where prohibited or restricted by law. You are responsible for checking applicable laws and regulations in your jurisdiction before participating in the Giveaway to make sure that your participation is legal. You are responsible for all taxes and reporting related to any award that you may receive as part of the Giveaway.
A breach of any of these warranties will result in the corresponding entry being invalid, as well as other legal obligations.
Sponsor reserves the right to disqualify any entrant who Sponsor determines has:

violated these Official Rules;

tampered or attempted to tamper with the entry process;

used automated, fraudulent, or deceptive methods to enter;

submitted false or misleading information; or
-
attempted to interfere with the legitimate administration of the Giveaway.
Sponsor reserves the right, subject to applicable law, to cancel, suspend, modify, or terminate the Giveaway if fraud, technical failures, unauthorized intervention, force majeure events, or other circumstances beyond Sponsor’s reasonable control impair the integrity or proper operation of the Giveaway.
If the Giveaway is terminated before the scheduled end date, Sponsor may select a winner from eligible entries received before termination.
11. RELEASE AND LIMITATION OF LIABILITY
By participating in the Giveaway, entrants agree, to the fullest extent permitted by law, to release and hold harmless Stila Cosmetics, the participating creator, Lionsgate, Instagram, TikTok, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, representatives and agents from claims, damages, losses, or liabilities arising out of or relating to participation in the Giveaway or the acceptance, possession, use, or misuse of any prize.
Sponsor is not responsible for technical failures, interrupted or unavailable network or platform services, lost or delayed entries, incorrect entry information, unauthorized human intervention, or other errors or circumstances that may affect an entrant’s ability to participate.
12. PUBLICITY
Except where prohibited by law, acceptance of a prize constitutes the winner’s permission for Sponsor to use the winner’s name, social media handle, likeness, photograph, voice, city and state of residence in connection with announcing or promoting the Giveaway without additional compensation.
13. PLATFORM RELEASE
By participating in this Giveaway, each entrant acknowledges and agrees that the Giveaway is not sponsored, endorsed, administered by, or associated with Instagram, TikTok, or Lionsgate.
Each entrant releases Instagram, TikTok, and Lionsgate from any responsibility or liability arising from or related to the Giveaway.
Any questions, comments or complaints regarding the Giveaway should be directed to Stila Cosmetics and not to Instagram, TikTok, or Lionsgate.
14. PERSONAL INFORMATION
Personal information collected in connection with the Giveaway will be used for purposes of administering the Giveaway, confirming eligibility, contacting potential winners and fulfilling prizes, and will be handled in accordance with Stila Cosmetics’ Privacy Policy available at StilaCosmetics.com.
15. GOVERNING LAW AND VENUE
Entrant agrees that: (a) Claims arising out of or connected with this Giveaway, or the prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in New York, New York; (b) Entrant submits to sole and exclusive personal jurisdiction to said courts in the State of New York for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (c) any and all Claims, judgments, and awards shall be limited to actual damages of out-of-pocket expenses associated with entering this Giveaway, but in no event attorneys’ fees; and (d) under no circumstances will Participant be permitted to obtain awards for and Participant hereby waives all rights to claim punitive, incidental, and consequential damages or any other damages, and any
and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with this Giveaway, shall be governed by and construed in accordance with, the laws of New York in the United States, without giving effect to any choice of law or conflict of law rules.
VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
